NOVEMBER 7, 2016
The Council of the City of Augusta, Kansas met in regular session on November 7, 2016, with Mayor Matt Childers presiding. Council present were Jason Lowery, Cale Magruder, Jamie Crum, Paul Belt, Mike Rawlings, Tom Leffler, and Ron Reavis. Councilman Justin Londagin was absent. Also present: City Manager Josh Shaw, City Attorney Austin Parker, Assistant City Manager Cody Sims and City Clerk Erica Jones. Visitors present were: Belinda Larsen, John Black, Charles Greenwell, Nin George, Avin George, Tyler Brewer, Linda Brewer, Dan Allen, Stephanie Cole, Kim Galgon, Colleen Beckley, Ray Marbut, Chad McCluskey, Jeremy Johnston, Chris Schueber, Derrick Highbarger, Shane Noland, Eric Birk, Steve Spencer Scott Cheslic and Zachary Blue.

Prayer: Pastor Steve Spencer, First United Methodist Church, gave the invocation.
Minutes: Leffler made a motion to approve the minutes from the October 17, 2016 Council meeting. Lowery seconded the motion. Motion carried without opposition.
Ordinance 10A and 11: Crum made a motion to approve Ordinance 10A in the amount of $1,073,831.91 and Ordinance 11 in the amount of $373,208.19. Leffler seconded the motion. Motion carried without opposition.
Avin George: Avin George was present to request approval for the placement of six fish habitats at Augusta City Lake to create fish habitats and improve fishing. He stated they will be built at the Augusta High School and be placed at the lake this weekend if approved. George stated that Ace Hardware has agreed to cover the costs of three of them and requested that the City pay for the other three at a cost of $390. Belt made a motion approve the placement of six fish habitats at Augusta City Lake and to fund the cost of three of the habitats. Rawlings seconded the motion. Motion carried without opposition.
The Council recognized Ray Marbut, Fire Major for 40 years of service; Erica Jones, City Clerk/Director of Finance; Colleen Beckley, Public Safety Administrative Assistant; Stephanie Cole Public Safety Communication Specialist; Dan Allen, City Inspector; and Shane Noland, WWTP Lab Technician for 10 years of service.
First Amendment to Infrastructure Development Refunding Agreement with Appcon Services: Reavis made a motion to approve the First Amendment to Infrastructure Development Refunding Agreement with AppCon Services for a change order in the amount of $6,410 related to realignment of water and sanitary sewer infrastructure improvements. Rawlings seconded the motion. Motion carried without opposition.
2016 Street Sales Tax Program Project Award Recommendation: Leffler made a motion to approve a bid award to APAC-Kansas, Inc. for the 2016 Street Sales Tax Program in the amount of $115,613.95 for improvements to Washington Lane, Cemetery Road, and thermal crack repair in Lakeside II Addition. Lowery seconded the motion. Motion carried without opposition.
Bid Award for the Shryock Park Parking Lot Improvements: Rawlings made a motion to approve a bid award to McCollom Construction, Inc. in the amount of $181,083.10 for the base bid and alternate 1 for parking lot improvements at Shryock Park. Crum seconded the motion. Motion carried without opposition.
Ordinance 2106 Regulating Parking of Vehicles upon Private Property within the City of Augusta, Kansas: Rawlings made a motion to approve Ordinance 2106 regulating parking of vehicles upon private property within the City of Augusta, Kansas with “up to…” added to the fine amounts. Belt seconded the motion. Roll Call: Reavis Yea, Leffler Yea, Belt Yea, Magruder Yea, Lowery Yea, Crum Yea, and Rawlings Yea. Motion carried.
Schedule Public Hearing to Amend the 2016 Budget: Lowery made a motion to table this agenda item. Magruder seconded the motion. Motion carried without opposition.
Matters From/For Council and Informational Memorandum:
Reavis: Reavis stated we gave away some award money out of the departmental fund and didn’t want to see those departments penalized. Shaw explained that the service award money comes out of the salary line item of the department the employee works for.
Magruder: Magruder stated he was glad for the discussion tonight and that it is worth the patience they show with one another to discuss these things.
Childers: Childers asked for an update on the docks at the Augusta City Lake. Sims stated staff expects the gangways and docks to be delivered between the 11th and 15th of this month and they will be installed shortly thereafter.
At 8:25 p.m. Lowery made a motion to go into executive session for 60 minutes under the personnel matters exception to the Kansas Open Meetings Act to discuss personnel matters of non-elected personnel and to conduct the City Manager’s annual performance evaluation. Lowery asked that City Manager Josh Shaw join the Council in the executive session. The governing body will reconvene in the Council Chambers at 9:25 p.m. Leffler seconded the motion. Motion carried without opposition.
At 9:25 p.m. Lowery made a motion to exit executive session with no action being taken. Rawlings seconded the motion. Motion carried without opposition.
