CITY COUNCIL

FEBRUARY 21, 2017

7:00 P.M.

 

The Council of the City of Augusta, Kansas met in regular session on February 21, 2017, with Mayor Matt Childers presiding. Council present were Jason Lowery, Jamie Crum, Tom Leffler, Mike Rawlings, Ron Reavis and Justin Londagin. Council Members Paul Belt and Cale Magruder were absent. Also present: City Manager Josh Shaw, City Attorney Austin Parker, Assistant City Manager Cody Sims and Director of Public Works Jaime Goering. Visitors present were: Belinda Larsen, Elmer Simon, Connie Thurman, Rebecca Wetzel, Nick Hoefgen, Angie Johnston and Bill Slade.

 

Pledge of Allegiance

 

Prayer: Pastor Steve Spencer, First United Methodist Church, gave the invocation.

 

Minutes: Crum made a motion to approve the minutes from the February 6, 2017 Council meeting and the February 13, 2017 City Council Joint Work Session. Leffler seconded the motion. Motion carried without opposition.

           

Ordinance 2: Leffler made a motion to approve Ordinance 2 in the amount of $444,670.53. Rawlings seconded the motion. Motion carried without opposition.

 

Business:

Adopt a Code of Conduct for City Officials; Adopt a Public Works Procurement Policy; Adopt a Civil Rights/Fair Housing Policy; Community Development Block Grant Agreement with HUD; Authorize Signatures: Crum made a motion to approve a Code of Conduct Policy for City Officials in accordance with CDBG grant requirements. Rawlings seconded the motion. Motion carried without opposition.

 

            Crum made a motion to approve a Public Works Procurement policy in accordance with CDBG grant requirements. Londagin seconded the motion. Motion carried without opposition.

 

            Crum made a motion to approve a Civil Rights/Fair Housing Policy in accordance with CDBG grant requirements. Londagin seconded the motion. Motion carried without opposition.

 

            Crum made a motion to approve the Community Development Block Grant Agreement no 17-PF-001 in the amount of $500,000 with the Department of Housing and Urban Development (HUD). Londagin seconded the motion. Motion carried without opposition.

 

            Crum made a motion to authorize officials to sign the signature form. Leffler seconded the motion. Motion carried without opposition.

 

2017 Street Sales Tax Project Recommendations; Engineering Services Agreement with Schwab-Eaton for Design of 2017 Street Sales Tax Projects; Authorize Staff to Initiate Temporary Note Financing with Bond Counsel: Londagin made a motion to approve an Engineering Services Agreement Part A with Schwab-Eaton in the amount of $138,000 for design engineering services for the 2017 Street Sales Tax Projects. Leffler seconded the motion. Motion carried without opposition.

 

            Londagin made a motion to authorize staff to initiate temporary note financing with the City’s Bond Counsel. Rawlings seconded the motion. Motion carried without opposition.

 

            Reavis made a motion to approve bid option 1 for 2017 Street Sales Tax Projects. Leffler seconded the motion. Motion carried without opposition.

 

KDOT Authority to Award for South Ohio Street Construction Project: Crum made a motion to approve the bid award to Conspec Inc., DBA Kansas Paving in the amount of $3,120,354 for the South Ohio Street Project. Londagin seconded the motion. Motion carried without opposition.

 

Police Vehicle Bids: Rawlings made a motion to approve the bid award to Don Hattan for the Marked Tahoe in the amount of $26,964. Leffler seconded the motion. Motion carried without opposition.

 

Matters From/For Council and Informational Memorandum:

Reminder of the Strategic Budget Retreat scheduled for Monday, February 27, 2017 at 6:00 p.m.

 

Reminder of Sidewalks Work Session scheduled for Monday, March 13, 2017 at 6:00 p.m.

 

Leffler: Leffler stated he received calls about the status of the Washington Lane street project. Goering stated they are starting work on the cemetery road and then will start on Washington Lane, hopefully within the next month.

 

Childers: Childers stated he was contacted about the absence of a noise ordinance as it relates to residential neighborhoods. He stated there is one for vehicles, but he wanted to put this on the Council’s radar for consideration of having staff review this for them. He stated he would like to give the Council a couple weeks to research it on their own to see if there is a need for a noise ordinance and he will bring it back at the next meeting to seek their opinions. Childers stated this is the first community he has lived in that doesn’t have a noise ordinance.

 

Crum: Crum stated there is a huge pothole on Washington Lane between PT Plus and the Baptist Church and asked if that could be patched. Goering stated it should have a cold patch repair this week in anticipation of the upcoming project.

 

Reminder of the Park Board Meeting at City Hall on February 22, 2017 at 6 p.m.

 

Executive Session

At 8:10 p.m. Lowery made a motion to go into executive session for 25 minutes under the Attorney-Client privilege and preliminary discussions related to the acquisition of real property exceptions to the Kansas Open Meetings Act for discussion of matters deemed privileged in the attorney-client relationship and for preliminary discussion related to the acquisition of real property for future expansion of public works facility. Lowery asked that City Manager Josh Shaw, Assistant City Manager Cody Sims and City Attorney Austin Parker join the Council in the executive session. The governing body will reconvene in the Council Chambers at 8:35 p.m. Leffler seconded the motion. Motion carried without opposition.

 

At 8:35 p.m. Lowery made a motion to exit executive session with no action being taken. Londagin seconded the motion. Motion carried without opposition.

 

Londagin made a motion to schedule a special meeting for Thursday, February 23, 2017 at 6:00 p.m. to discuss potential land lease agreement between the City of Augusta and Pray Aviation. Leffler seconded the motion. Motion carried without opposition.

 

Adjourn: At 8:20 p.m. Londagin made a motion to adjourn. Leffler seconded the motion. Motion carried without opposition.
